The terms on which this service is provided and used.
1. Who these terms are between
These terms are between Infin8 Digital Limited ("we", "us") and the organisation whose staff use Highways Transparency Reporter ("you"). Using the service means accepting them.
Two other documents sit alongside these and take precedence within their own subject: the Data Processing Agreement governs personal data, and the Dual-Tier Licensing Terms govern what may be done with a generated report.
2. What the service does
It helps a local highway authority prepare, check and publish the highways maintenance transparency report the Department for Transport asks for. It prefills figures from published statistics, applies the Department's own consistency checks, and exports Word documents in the Department's template.
What it does not do is guarantee an outcome. We do not warrant that a report produced here will be accepted by the Department, will satisfy any funding condition, or will be free of error. The checks built in are the ones we know about; they are an aid to your review, not a substitute for it.
The report you publish is your report, and confirming it is your responsibility. Every answer in it has to be checked by your authority before you publish — every figure, every link, and every sentence, including the ones prefilled from published statistics and the ones the drafting assistant wrote. Nothing is confirmed on your behalf: an answer the assistant produces arrives marked unconfirmed and stays that way until somebody at your authority says otherwise, and the check step exists to make the ones nobody has read impossible to miss. Publishing a report is your authority stating that its contents are accurate.
3. Accounts
- Sign-in is by one-time code to a work email address. Keep access to that mailbox secure; anyone who can read it can sign in as you.
- Do not share an account. Invite colleagues to your organisation instead — it is free, and it is what makes the change history meaningful.
- Tell us promptly if you believe an account has been compromised.
- You are responsible for what is done under your accounts.
4. Acceptable use
You agree not to:
- use the service unlawfully, or to store unlawful content;
- upload material you have no right to upload, or that contains malware;
- upload special category personal data, or personal data beyond what the Department's template requires;
- attempt to gain access to another organisation's reports or data;
- probe, scan or load-test the service without our written agreement — if you want to security test it, ask, and we will usually say yes and agree a window;
- remove, alter or obscure any notice, watermark or identifying code in a document the service produces;
- resell or provide the service to a third party as your own, unless you are a consultancy acting for named authorities, which is expressly allowed.
5. Your data stays yours
You own the content you put into the service and the answers it holds. We claim no ownership of it. We hold it as your processor under the Data Processing Agreement, and you can export everything you have entered at any time from the Publish step.
What we own is the software, the question schema, the checking rules and the drafting that the service generates. See the Dual-Tier Licensing Terms for what you may do with a generated report — the distinction matters and it is set out there.
6. Availability
We aim for the service to be available whenever you need it, and we will give reasonable notice of planned maintenance where we can. We do not offer a contractual uptime guarantee under these terms. If you need one, it can be agreed separately in writing.
The service depends on GOV.UK for published statistics and, if you have enabled it, on a third-party AI provider. Neither is under our control, and the service is built to carry on usefully when either is unavailable.
7. Payment
Preparing a report costs nothing. Publishing one requires a Public Distribution Licence, bought by purchase order and settled by invoice. No card payment is taken through this service at any point. Invoices are payable on the terms stated on the quotation.
8. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, and to the fullest extent the law allows:
- we are not liable for loss of profit, loss of anticipated savings, loss of funding or grant, loss of business or reputation, or any indirect or consequential loss;
- our total liability in connection with any report is limited to the licence fee you actually paid us for that report;
- where no Public Distribution Licence has been purchased for a report, we have no liability in connection with it. Preparing, checking and reviewing a report costs nothing, and nothing is what it is worth as a warranty — an evaluation copy is an aid to your own work and carries no promise about its contents;
- we are not liable for the accuracy of published statistics obtained from GOV.UK, nor for the output of an AI provider you have chosen to enable — both of which the service presents to you for your review rather than adopting on your behalf.
These limits are the basis on which the service is priced. A report costs a fraction of the officer time it replaces, and it could not be offered at that price carrying open-ended liability for a published document that your authority signs off and we never see.
9. Ending it
You may stop using the service at any time and ask us to delete your data. We may suspend or end access if these terms are breached materially and the breach is not put right within 14 days of us asking, or immediately where the breach is unlawful or puts other users at risk.
A Public Distribution Licence already granted survives the end of these terms. You paid for the right to publish a report and you keep it.
On termination we will make your data available for export for 30 days and then delete it.
10. Changes to these terms
We may change these terms. Material changes are announced in the service at least 30 days before they take effect. Continuing to use the service after that is acceptance; if you would rather not, tell us and we will help you export your data.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Nothing here affects any statutory right you have as a public body.
